Application of terms and conditions. 

The terms and conditions laid out herein applies to all items pre-ordered at Ultimate Toys and/or sold and/or quoted by Ultimate Toys.

The Spirit of Fair Play.

Because we are first and foremost collectors ourselves, and our store is built and run as a hobby first and a business second, we always strive to be flexible and we uphold the win-win policy. However, there are times when unethical customers may try to take advantage of us and/or our system. It is necessary to lay down the ground rules so that arguments can be prevented and/or resolved.

Therefore, we would like to officially lay down the following ground rules for pre-ordering, always keeping sensibility and fair play in mind.

Minimum Deposit.

A minimum deposit of 20% (sometimes 30% or more) will be required for each pre-orderable item.

Customers outside of KL and PJ may place their pre-orders via e-mail but their pre-orders must be secured with 100% upfront payment, before delivery. Alternatively, they may request the assistance of a friend to make a 20% (or more) deposit on their behalf.

A pre-order is considered secured only when the appropriate amount for deposit or full pre-payment is made. Verbally made pre-orders without the necessary $ deposits do not guarantee that the pre-order is secured.

"Secured" means that we will to the best of our ability attempt to secure the relevant stocks, to fulfill the order. It does not mean that pre-orders will be fulfilled 100% of the time, as there are many circumstances beyond our control.

Ultimate Toys reserves the right to provide refunds for orders which it no longer wishes to support/accept/fulfill.

Pre-order status.

All pre-orders are subject to stock availability. Sometimes manufacturers and suppliers are unable to stick to a delivery schedule and sometimes they are unable to fulfill their promise on quantities. Sadly, this is a real possibility for almost all products.

However, to the best of our ability, we will only work with dependable, reliable and timely suppliers to protect your interests. But it pays to bear in mind that suppliers are only human. :) And so are we! :)

For items for which severe shortage occurs, we will revert to the fairest basis which is first-pre-ordered, first-served. So it always pays to be quick and decisive when it comes to pre-ordering. "Early birds get their figure!" so to speak. :)

Please retain your pre-order receipts. You will need them when you want to collect your pre-order receipt. Lost receipts may incur a 10% penalty based on the selling price.

Please note that the expected release dates are subject to change at the manufacturer's discretion. Also keep in mind that even when an item has been released, your order may not be able to ship out of the first shipment. This will all depend on how many are received and when your order was placed in relation to the rest of our pre-orders.

Changing your pre-order or cancelling it.

Once pre-orders have been submitted to suppliers/manufacturers, no refunds or cancellations can be entertained.  Pre-orders once locked in cannot be retracted and no cancellations by customers can be entertained.  Please note that no exceptions can be made and this is not open to negotiation. Refunds, changes and cancellations will only be possible for pre-orders which haven't been submitted to suppliers/manufacturers. 

Ultimate Toys reserves the full right to determine if and when the refunds and/or changes and/or cancellations can be made. You may have the assurance that we will always strive to be fair in our dealings and decisions.

For the record, though, Ultimate Toys reserves the right to approve or disapprove, accept or cancel, bring forward or postpone all pre-orders and pre-orderable items.

Please bring along your receipt as proof-of-pre-order when collecting items that have arrived. Lost receipts may incur a 10% penalty off the selling price.

Part Shipment.

In the event of part shipment (partial shipment), collection of pre-orders will be done on a first come first served, basis, in lieu of subsequent shipments. We will at all times do our best to secure stock for pre-orders but often, we are subject to last minute changes on the part of suppliers/manufacturers, over whom we have little control. Customers should understand that this is part and parcel of the toys and collectibles industry.

Collecting your pre-order.

Failure to make full-payment for and collect a pre-ordered item within a reasonable period of 3 weeks (sometimes 1 month) of its arrival at our store, may cause the deposit to be forfeited. The uncollected/unpaid for item may be sold at Ultimate Toys' discretion and deposits forfeited. The decision to confiscate deposits after the 1 month grace period will be entirely up to Ultimate Toys. This is to ensure that abuse of the privilege to pre-order and lay-by does not happen, especially in lieu of space limitations.

This is also to ensure that payment and collection within a reasonable period takes place, so that no financial damage is inflicted upon Ultimate Toys. Notices of arrival will, of course, be sent via e-mail. But customers who fail to collect their items and exceed the 3 week period will have their items automatically classified as uncollected/unpaid items at the discretion of Ultimate Toys.

Refunds.

In the event that a pre-ordered item doesn't reach Ultimate Toys within a reasonable period, a full refund of the deposit and/or pre-payment will be made. Transfers of deposits for another pre-orderable item can also be made.

A reasonable period would be no more than 6 months from the date of the pre-order, in most cases. But again, this is truly subject to suppliers/distributors/manufacturers. Deliveries of fine products from Sideshow WETA, Master Replicas, Cinemaquette and United Cutlery, which are finely intricate in detail and require significant skills to produce, are exceptions to this rule.

For certain manufacturers, of especially limited edition pieces, items may be pre-sold out way ahead of actual production dates.  Production may only commence many months later from the closing date of pre-orders. 3, 6 or even more months from the pre-sold-out-dates is fairly common. Furthermore, it is the norm for fine products, which often require intricate skills over a period of time, to be released in small batches over a period of time. In such situations, the reasonable period will default to "as long as it takes", on the part of the manufacturer/distributor and therefore, our obligation to fulfill orders, too.

This also includes seasonally manufactured/released items (e.g. licensed t-shirts, masks, posters, standees, costumes) for which we do not have any control.

Warranty.

Typically, manufacturers outside Malaysia, do not provide applicable warranty coverage for toys, electronic or not for products sold in Malaysia. Most terms are applicable only in sizeable markets i.e. USA and Europe in which they are headquartered.

Therefore, unless the manufacturer or distributor is expressly present in Malaysia as an establishment/business entity, and does explicitly offer warranties for products sold in Malaysia, and only if the warranty is valid as they deem fit,  it is accurate to assume that all items sold at Ultimate Toys are not entitled to any warranty claims so exchanges, repairs and replacements are not the obligation of Ultimate Toys, as there is no back-to-back arrangement available between Ultimate Toys and the supplier/manufacturer/distributor.

Most reputable manufacturers will honour their warranties but only if the items are sent directly to their headquarters (usually located in the US or Europe)  for repair/replacement/investigation. Ultimate Toys will not be bear such costs as shipping, freight, taxes and re-importing of the relevant damaged or faulty goods. This will solely be the responsibility of the customer.

Goods return policy.

The rule of caveat emptor applies (i.e. buyer beware) and thereby all goods sold are not returnable.

Determination of policies.

At all times, Ultimate Toys reserves the right to make any changes on all amendments, descriptions, updates, variations, assortments, prices, discounts, VIP points, etc., as it may deem fit, at its own discretion.

Forfeiture.

Pre-order deposits may be forfeited in the event that;

1. Item(s) ordered has/have not been collected 1 month from the date of notice, by way of e-mail and/or sms and/or phone call, of arrival of the said item(s) and/or

2. Repeated unfair requests or nasty behaviour with regards to pre-orders, which have already exceeded the 1 month collection period.

The discretion is entirely Ultimate Toys'. The above is enforced to the letter due to earlier experiences we have had with customers who take ages to collect their orders despite notifications and reminders, which therefore had a negative impact on Ultimate Toys'  financial position and space availability.

Responsibility for notification.

We will always send out e-mails regarding new shipments and the arrival of pre-ordered items. It is the responsibility of the collector/customer to register with us via e-mail for updates.

Ultimate Toys cannot and will not be held responsible for e-mail boxes that have exceeded their quota limits and thus e-mails we have sent, end up bouncing.

Ultimate Toys cannot and will not be held responsible for e-mails which have not been read.

Apart from e-mail, the onus first lies on the collector to contact us for updates or to check for updates on our website. However, website updates are not done as often as we would like to.

Price changes. 

Please allow for a 10% to 15%  variance, between the estimated pre-order price and the actual final retail price. The variance is usually applicable to imported items for which foreign freight, currency exchange rate fluctuations and of course, taxes. This usually works both ways, both for price increases and lower prices, subject to the final expenses incurred in importing the items.

Final say.

Genuine collectors, who value integrity, may be rest assured that our dealings with them will always be sincere, fair and considerate, to the best of our ability. As much as we seek to be considerate, to the best of our abilities, we are also asking our fellow collectors to be considerate and fair in their requests and expectations. 

Whilst we try to remind ourselves that we shouldn't allow a few bad apples to spoil the whole basket of apples, we have had our fair share of unreasonable requests by a small number of unfair, self-centered, unpleasant collectors. Hence, the need to officially state all of the terms and conditions above in "ink".

Applicability.

Ultimate Toys will enforce all policies stated on its website at all times. Customers are advised to be mindful of the rules and regulations, terms and conditions of their purchases as per the policies listed here. As we are ourselves subject to the rule of caveat emptor in most of our purchases, customers are advised that the rule of caveat emptor is the reasonable default for all pre-orders, purchases, etc.
